I’m thinking about separating or have just separated. Where do I start?

This can be a difficult time for you and your family, so it is important to know where you stand.

If things are amicable, you can negotiate an agreement with the other party directly or through a mediation and then ask lawyers to help you formalise your agreement.

However, if you have complex or substantial assets (e.g. you have companies and/or trusts, a self-managed super fund, or multiple investment properties) or parenting concerns (e.g. one party is threatening to relocate to a different country or city, or one party alleges the other is a risk to the children), it is important to seek legal advice from an experienced family lawyer about strategy before you start negotiations.

Why is Modern Divorce so cheap?

Modern Divorce is cheap because we are an online-only firm. We don’t offer face to face meetings and we don’t do disclosure or “process” type settlements. Our services are limited to providing advice (which you can use to negotiate with your spouse directly) and preparing settlement documents. Because you attend to the “process” yourself, you don’t spend time talking to a lawyer or having your lawyer negotiate on your behalf. That is the most expensive part of a traditional divorce process.

With us, you complete your form online and a lawyer will then draft and send you your completed advice or settlement documents. This helps us reduce our costs and makes it more affordable for you.

Why should I use your website for legal advice?

We are not a “generalist” website that does a bit of everything. Family law, divorce and de facto separation is our specialty. Our documents are prepared by lawyers who primarily practice family law.
